This agreement is entered into between Golden Age Entertainment (hereinafter referred to as Service Provider) and Subscriber.
1. The service provider agrees to deliver singing performances to bring joy and happiness through entertainment at the subscriber’s premises to benefit care home residents. The services’ scope, frequency, and timing will be delivered as outlined in this form.
2. Term of Contract: The initial term of this subscription begins on the date outlined in the subscription form and continues for 12 months unless terminated earlier under the terms outlined in our terms and conditions.
3. Subscription Fee: The subscriber agrees to pay a subscription fee of [Amount] per [session/month/year], payable on or before 30 days from the receipt of the invoices.
4. Rescheduling and Late Payment Policy
4.1 Rescheduling by Subscriber:
Rescheduling a session with less than one week’s notice before the scheduled
performance will incur an administrative fee of £20.
Rescheduling a session with less than three weeks’ notice before the scheduled
performance will incur an administrative fee of £10.
Rescheduling a session three weeks or more before the performance date is free of charge
4.2 Rescheduling by Provider:
The Provider reserves the right to reschedule a performance due to unforeseen circumstances (e.g., illness, emergency) and will provide reasonable notice to the Subscriber. In such cases, the session will be scheduled at a mutually agreed time.
4.3 Payment Policy:
Golden Age Entertainment values prompt payment to ensure seamless service delivery and maintain high-quality performances. This late payment policy outlines the terms and conditions surrounding payment timelines, notice of delays, and penalties for late payments.
4.3.1 Payment Terms
Subscribers are required to settle all invoices within 30 days of the invoice date
4.3.2 Notice of Payment Delays
Subscribers experiencing payment delays must inform Golden Age Entertainment’s administration team immediately in writing. The notice must include the reason for the delay and the revised payment date. Late payment fees will be applicable if the revised payment deadline is missed.
4.3.3 Late Payment Fees
A late payment fee of £5 per day will be applied to any outstanding invoice after 30 days if no prior notice is provided as outlined in section 4.3.2
4.3.4 Penalty for Further Delays
If a subscriber fails to make payment by the revised payment deadline provided in writing, a penalty fee of £35 will be charged in addition to the late payment fee incurred after the revised payment date.
4.3.5 Additional Notice
Golden Age Entertainment reserves the right to suspend services or performances for accounts with outstanding payments beyond the permitted timelines.
Continued failure to comply with the payment terms may result in the termination of services and further collection efforts
4.4 Termination:
The subscriber may terminate this contract free of charge within 30 days from subscription commencement. A written notice will be required.
In the event of termination by the subscriber after the 30-day cooling-off period, any outstanding subscription fees and cancellation charges (£150 exit fee) will remain payable.
5. Provider Responsibilities: Golden Age Entertainment agrees to:
Deliver high-quality performances as per the agreed schedule.
Provide necessary equipment (e.g., microphones, sound system) for each session.
Maintain professionalism and comply with care home policies during performances.
7. Subscriber Responsibilities: The subscriber agrees to:
Provide a suitable performance space.
Ensure the safety and well-being of the staff of Golden Age Entertainment while on the premises.
Notify the management of Golden Age Entertainment promptly of any changes or issues affecting the scheduled performances and payments.
8. Limitation of Liability: Golden Age Entertainment will not be held liable for any
damages, losses, or injuries arising from the performance or services except where caused by the Provider’s negligence or willful misconduct.
9. Confidentiality: Both parties agree to maintain the confidentiality of any
information shared during the term of this contract, and to always comply with GDPR.
10. Governing Law: This contract shall be governed by and construed following the laws of the UK.
11. Entire Agreement: This contract constitutes the entire agreement between the parties and supersedes all prior agreements or understandings, whether written or oral.
12. Signatures: By signing below, both parties agree to the terms and conditions outlined in this contract.
